Terms of service
Last reviewed:
These terms govern your use of TransportPlanAI ("the Service"). By creating an account, you agree to be bound by them. If you don't agree, please don't sign up.
We are TRANSPORTPLANAI LTD, a company registered in England and Wales (company number 17184174) with registered office at 1 Medlock Crescent, Ashton Under Lyne, Manchester, England, OL6 9FL, United Kingdom ("we", "us", "our"). You are the person or entity using the Service ("you", "your").
1. The service
TransportPlanAI helps transport planning professionals generate transport assessments using AI-assisted workflows. It combines public reference data (UK NaPTAN, Stats19, DfT count points, etc.) with user-provided project inputs and AI-generated analysis.
The Service is provided "as is" - see §10 on limitations.
1.1 A tool to assist you, not a complete planning service
The Service helps a qualified transport planning professional with parts of their work, such as gathering site data, drafting report sections, and preparing figures and exports. It does not carry out a complete transport planning commission from start to finish, and it is not designed to. In particular, it does not:
- Replace site visits, traffic surveys, junction or network modelling, or any other technical work your commission requires.
- Agree scope, methodology, or assumptions with the highway authority, planning authority, or other consultees.
- Decide what is submitted, signed off, or recommended to a client or authority.
- Act as, or take on the responsibilities of, the transport consultant for any project.
You remain responsible for the planning work and for every document, figure, and recommendation you produce with the Service's help.
1.2 You must check and verify all output
All output of the Service must be checked and verified by you before you rely on it, share it, or submit it. This applies to everything the Service produces, not only the AI-generated content described in §6. It includes site data pulls, public reference data, accessibility and collision summaries, trip generation and other calculations, maps and figures, policy and parking-standard references, and Word or other exports.
Output may be incomplete, out of date, or wrong, including because of errors in third-party source data or defects in our own software. Our liability in respect of output is set out in §6.4 and §10.
1.3 A service in active development
TransportPlanAI is a new service that is still being developed. You should be aware that:
- We release new features, tools, and improvements regularly. Some are made available to all users, including paying users, while we are still refining them based on real-world use.
- Features may change, behave differently from earlier versions, or be withdrawn.
- The Service may contain defects that we have not yet found or fixed, and those defects may affect output.
- We may label some features "beta", "preview", or similar. Those features are more likely to change or to contain errors.
Because the Service is developing, the requirement in §1.2 to check and verify all output is especially important. If you find an error, please tell us at support@transportplanai.co.uk so we can fix it.
If we make a change that materially reduces the Service you have paid for, we will handle it under §9 (notice and the option to cancel). This section does not limit our liability beyond what §10 allows, does not affect §10.4, and does not affect your statutory rights if you are a consumer.
2. Who can use the service
- You must be at least 18 years old.
- You must have the legal authority to enter into these terms (if signing up on behalf of an organisation, you confirm you can bind it).
- You must use the Service for professional transport planning purposes, not for personal entertainment or illegal activity.
- You must comply with all applicable laws in your jurisdiction.
- The Service is for business use only. You must be using it in the course of your trade, business, or profession (for example as a sole trader, partnership, company, public body, or an employee or contractor of one), and not as a consumer. When you create an account you confirm this, and we record that confirmation.
We may decline new signups or close existing accounts at our discretion (with notice and prorated refund where you've paid in advance), particularly if we believe the account is being used to abuse the service or violate these terms.
We do not offer the Service to consumers. If, despite your confirmation, you are treated as a consumer under UK law, the provisions of these terms that refer to consumers (including in §5.4, §10, and §11) apply to you, and nothing in these terms affects your statutory rights.
3. Your account
- One person, one account. Multiple accounts per individual are not permitted (the Practice plan is the route for multiple users - see §5).
- Keep your password and access credentials confidential. You're responsible for activity under your account, except where it results from our failure to apply the security measures we say we apply in the Privacy Policy.
- Email verification is required before any paid action. We'll send you a verification email at signup.
- We may revoke any session that we believe is being used fraudulently or in violation of these terms. You can revoke your own sessions any time in Settings → Active Sessions.
4. Acceptable use
You agree NOT to:
- Use the Service to do anything illegal under UK law (or applicable law in your country).
- Submit content that you don't have the right to submit (third-party copyrighted material without permission, etc.).
- Attempt to circumvent rate limits, billing, or access controls.
- Reverse-engineer, decompile, or attempt to extract our AI prompts, system architecture, or proprietary logic except as permitted by law (Copyright Designs and Patents Act 1988 s.50A-C for compatibility, etc.).
- Use the Service to develop a competing product.
- Submit prompt-injection payloads designed to extract our system prompts, manipulate the model into producing content outside its intended purpose, or otherwise abuse the AI integration.
- Share your account credentials with others, lend, sub-licence, sell, transfer, resell, or rent access to your account or the Service. The Practice plan is the only permitted route for multiple users (see §5); collective accounts shared across colleagues to avoid Practice seats are a breach.
- Use automated tools (scrapers, crawlers, bots, or any automated client) to extract data from the Service or to interact with it in ways not explicitly supported by our published interfaces and rate limits. Programmatic access is allowed only via the public API endpoints we document.
- Piggyback on the Service to provide a derivative or wrapper service to your own customers without our written consent (including white-label resale, agency-style "we run it for you" services, or reselling generated outputs as bespoke deliverables outside the scope of a transport planning instruction). Using the Service in your own client work as part of your professional practice is permitted and expected.
- Probe, scan, or test the vulnerability of the Service except under a coordinated disclosure programme advertised at
/.well-known/security.txt. - Use the Service to generate content that is defamatory, harassing, discriminatory, or otherwise unlawful.
Violations may result in account suspension, termination, and (for serious or sustained violations) legal action.
5. Plans, payment, and billing
5.1 Plans
We offer PAYG and four subscription tiers (current launch lineup; subject to change for new signups per §9):
| Tier | Use case | Credit allowance | Price |
|---|---|---|---|
| Extract | Site data extraction without report generation | 25 site data pulls / month; no report credits | £35 / month (annual: £350, 2 months free) |
| PAYG | Occasional projects | 2 non-expiring credits and 8 site data pulls (lifetime, no reset) | £69 one-off |
| Studio | Single professional | 16 credits / month | £199 / month (annual: £1,990, 2 months free) |
| Practice | Multiple users at the same organisation | 16 credits / seat / month, pooled | £149 / seat / month (annual: £1,490 / seat, min 2 seats, so £298 / month minimum) |
| Enterprise | Larger orgs with custom needs | Custom | Contact us |
Credit model: pulling a site's data uses 0 report credits, subject to the allowance shown in the in-app usage panel. Extract includes 25pulls per billing period and no report credits. Extract subscribers may buy a PAYG pack for report credits without changing plans; monthly pulls are used before the pack's lifetime pulls. Subscription allowances reset each billing period; trial and PAYG allowances do not reset. Reaching the pull allowance pauses further pulls and is never charged. Credits are consumed by the document produced: 4 credits for a Transport Assessment, 2 for a Transport Statement, 1 for a Transport Note. Automatic overage billing is not currently enabled: when the included credit allowance is exhausted, credit-consuming actions pause until the next billing period or a plan upgrade. We will update the checkout disclosure and these terms before enabling any metered overage charge. Credit costs for other tools within the Service are designed as each tool ships and disclosed in the in-app usage panel.
Regeneration: regenerating a section to correct an error we detect in it (for example a generation that failed, a warning our checks attached to it, an issue our pre-signature review found in it, or a check that stopped your Word export) is free, up to 2 corrections per section in each generation of a report. Regenerating a section for any other reason costs 1 credit. Regenerating a whole report costs the report's credits, unless it is needed because of a fault on our side (for example a generation of the report that did not complete). Changing a project's inputs and then regenerating counts as new work and is charged as above. Each full generation of a report includes one pre-signature review; further reviews of the same generation cost 1 credit each. The cost of a regeneration or a review is shown before you confirm it.
Plan prices are listed in your local currency at checkout. We use Stripe Tax for VAT / GST / sales tax automation - taxes are displayed inclusively or exclusively per your country's convention (UK / IE / US: exclusive; AU: inclusive).
A PAYG purchase ends any remaining free trial. Unused PAYG credits and data pulls carry forward without expiry, but cannot be transferred between accounts or exchanged for cash.
5.2 Trials
A 30-day trial period is offered to new signups: 8 site data pulls across the whole 30 days and no report credits, no card required. The trial covers the site data extract only and does not include AI drafting. The pull allowance does not reset during the trial. Trials cannot be repeated by the same person on a different email address - we use anti-abuse measures including disposable-email blocklists and IP rate limiting.
5.3 Payment
- Stripe handles all payment processing. We never see your card details.
- Subscriptions auto-renew at the end of each billing period unless you cancel.
- PAYG is a one-time payment and does not renew automatically.
- You can cancel any time from Settings → Plan & Billing → Open Stripe Customer Portal → Cancel. Cancellation takes effect at the end of the current period (you keep access until then).
- Failed payments: Stripe retries on a configured schedule (1, 3, 5, 7 days). After the final retry your account moves to
past_due; if not resolved within 30 days, your account is downgraded but not deleted.
5.4 Refunds
Our default position is straightforward: if you cancel within 14 days of your first subscription start and have not consumed any credits, you get a full refund, no questions. Beyond that, the rules below apply. The Service is for business use only (§2), so the business rules are the ones that normally apply.
- PAYG packs: a full refund is available on request within 14 days only if none of that pack's credits or site data pulls have been consumed. A full refund revokes that pack's remaining allowance. Once the pack has been used, no automatic refund applies except where required by law or where a failed generation is refundable under the rule below.
- Business subscriptions (all users, per §2 - sole traders, partnerships, limited companies, employer-purchased seats): the Consumer Contracts Regulations 2013 do not apply. Refund treatment:
- Within 14 days of first subscription start, no credits consumed: full refund on request.
- Within 14 days, any credits consumed: no refund. (Consumption signals satisfied use.)
- After 14 days: no automatic refunds for unused portions of a billing period. Subscription cancels at the end of the current period; you retain access until then.
- Annual subscriptions cancelled mid-year: pro-rated refund of the unused remainder, less an administration fee of up to £25 to cover payment-processing costs. Discretionary; we'll do this in good faith.
- At our discretion we may offer a goodwill refund where a sustained outage we caused has materially affected your use.
- If you are nonetheless a consumer (see §2): you may have a statutory 14-day right to cancel from the start of your subscription. Contact support to exercise it. If you expressly requested the service to begin during that period, the law may allow a proportionate charge for service already supplied. We do not treat access or credit use alone as a blanket waiver of your statutory rights.
- Failed AI generations (the AI failed to produce usable output through our fault, not yours - e.g. our infrastructure outage or a model service error on our side): the consumed credit is refunded to your monthly allowance automatically. No need to email.
Nothing in this section affects any statutory rights you have under UK consumer protection legislation if you are a consumer.
5.5 Price changes
We keep pricing changes transparent, and we never apply them silently.
- At signup, you get the price, plan, and monthly credit allowance shown to you at checkout.
- We may change the price, plan structure, or credit allowance of an existing subscription in future. If we do, we give you at least 30 days' notice by email and an in-app banner, and you can cancel before the change takes effect without penalty (your subscription simply ends before the new rate would apply).
- Annual subscriptions are protected for the term you have paid for: any change takes effect no earlier than your next renewal date.
- Changes you make yourself (upgrading or downgrading via the Customer Portal or the in-app plan picker) take effect when you choose them, with proration handled by Stripe.
That is the only way your price changes: by your own action, or with notice and a costless exit. We do not operate a price-lock or "grandfathering" guarantee. We can't promise your price will never change, because our own costs (chiefly the AI provider costs behind every generation) are not fully under our control. What we promise instead is that any change is never a surprise: you always get advance notice and the chance to leave before it applies.
If you ever find a pricing change on your account that you did not make and were not given notice of, that is a bug. Email us at billing@transportplanai.co.uk and we'll roll it back and refund any difference charged.
6. AI-generated content - read this carefully
This section matters most for what you actually use the Service for.
6.1 The AI generates drafts. You are the reviewer.
TransportPlanAI uses Anthropic's Claude AI to generate portions of transport assessments. The output is a draft. You - as the qualified transport planning professional using the Service - are responsible for:
- Reviewing every assessment before relying on it.
- Verifying factual claims against authoritative sources.
- Checking design defaults, calculations, and regulatory references against current applicable standards (Manual for Streets, DMRB, the relevant Local Plan, etc.).
- Exercising professional judgement in deciding what to submit, sign off, or recommend.
We do not submit assessments on your behalf. We do not certify them as fit for any specific planning application. The Service is a tool that accelerates your work - it does not replace your expertise or your professional duty of care.
6.2 What we do to make the AI useful
We take a number of engineering measures to improve the reliability of AI output, which currently include:
- Pinning model versions (no
latest- explicit, dated identifiers). - Schema-validating the output before it reaches you.
- Maintaining per-prompt evaluation sets that re-run on every prompt change.
- Citing sources where the AI references regulations or design standards.
- Recording generation metadata for cost, reliability, security, and auditability.
These describe our current engineering approach, not a contractual guarantee, and may change as the Service evolves.
6.3 What the AI may get wrong
- Hallucinated references - citing standards, sections, or policies that don't exist or apply.
- Outdated regulatory content - the AI's training data has a cutoff; recent Local Plan adoptions or DfT guidance updates may not be reflected.
- Numerical errors - wrong arithmetic, mis-applied factors, transposed digits.
- Off-topic or refusal output - flagged by our filters where possible, but not guaranteed caught.
You must check. We're transparent that this is the reality of AI-assisted tooling today; we mitigate as far as engineering can, but the professional review is yours.
6.4 Liability for AI output
To the extent permitted by law:
- We do not warrant that AI-generated content is accurate, complete, or fit for any particular purpose.
- We are not liable for losses arising from your use of AI-generated content where the loss could have been prevented by reasonable professional review.
- The Service is an aid, not a substitute for professional judgement.
This does not exclude or limit our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under UK consumer or B2B legislation.
6.5 AI transparency markings
When a project's recorded country is in the European Union, AI-bearing exports include a clear AI-assisted draft notice and machine-readable origin markings. These controls identify that AI generated or transformed part of the content; they do not certify that the content is accurate or professionally approved. Exports for non-EU projects are not marked by this control.
Where those markings are present, you must not intentionally remove, falsify, or tamper with them. The visible disclosure must also remain before publication or submission unless legitimate professional editing has produced a substantively human-reviewed publication, you take editorial responsibility for it, and applicable law permits the visible disclosure to be removed.
7. Intellectual property
7.1 Your content
You own the content you create and the assessments you generate. You grant us a limited licence to: store your content, process it through the AI as part of providing the Service, and display it back to you. We don't claim ownership; we don't train our models on your content (Anthropic doesn't train on API data by default, and we don't otherwise share your content with third parties).
You warrant that you own or have all necessary rights, licences, and permissions to the content you submit, and that your content - and our processing of it to provide the Service - does not infringe the intellectual-property, confidentiality, privacy, or other rights of any third party.
7.2 Our service
The Service itself (software, design, system prompts, evaluation sets, the curated reference data integrations, branding) belongs to us. You don't gain ownership of any of it by using the Service.
7.3 Generated assessments
The output the AI generates from your prompts is your content (per 7.1) once it's generated for you. However, similar prompts may produce similar output for different users - we don't guarantee uniqueness, and you can't claim infringement against other users producing similar content from similar inputs.
We also do not warrant that output generated for you is free of third-party rights, and we give no intellectual-property infringement indemnity in respect of generated output. Because output is a draft you must review (§6), you are responsible for checking - before you use, publish, or submit any output - that it does not infringe a third party's rights. To the maximum extent permitted by law we are not liable for any third-party intellectual-property claim arising from your use of generated output.
7.4 Third-party data
Public reference data (NaPTAN, Stats19, DfT count points, OSM, TEMPRO, etc.) is provided under its original licence terms (Open Government Licence, ODbL, etc.). We pass through whatever licence terms attach to the source data. We don't relicense it; you must comply with the source licence where it applies (e.g. ODbL attribution requirements for OSM-derived data).
7.5 Intellectual-property complaints and takedown
If we receive a credible complaint, or otherwise reasonably believe, that content you have submitted or output you are using through the Service infringes a third party's intellectual-property or other rights, or breaches §4, we may - without liability to you - remove or disable access to the affected content, suspend the affected features, or where necessary suspend your account, while we investigate. We will tell you what we have done and why, give you a reasonable opportunity to respond where practical, and restore access promptly if the complaint is not made out. Repeat or serious infringement may lead to termination under §12.
8. Service availability
We aim for high availability but do not provide a formal SLA at launch. Specifically:
- We don't commit to a numerical uptime percentage. We monitor uptime (BetterStack) and respond to incidents.
- Scheduled maintenance is announced where practical.
- We may need to perform emergency maintenance with little notice for security reasons.
- We may suspend the Service to deal with abuse, fraud, or security incidents.
If the Service is unavailable for a sustained period materially affecting your usage, contact us and we'll consider a pro-rated credit at our discretion.
9. Changes to these terms
We may update these terms. For material changes (the scope of the Service, your rights or obligations, or pricing) we'll:
- Notify you by email at least 30 days before the change takes effect.
- Display a banner in the application.
- Give you the option to cancel before the change applies.
Changes to the price, plan structure, or credit allowance of a subscription you already hold follow this same mechanism: at least 30 days' notice and a costless exit before the change applies, as set out in §5.5.
For minor changes (typos, clarifications, link updates) we'll update the page and bump the "Last updated" date.
We keep a dated version history of these terms, and will provide previous versions on request.
10. Disclaimers and limitation of liability
10.1 The Service is provided "as is"
To the maximum extent permitted by law, we exclude all implied warranties, conditions, or terms - including merchantability, fitness for a particular purpose, and non-infringement.
10.2 Types of loss we exclude
To the maximum extent permitted by law, and subject to §10.4 (losses we never exclude), we are not liable to you - whether in contract, tort (including negligence), breach of statutory duty, or otherwise - for any of the following, even if foreseeable and even if we were advised of the possibility:
- Loss of profits, revenue, or anticipated savings.
- Loss of business, contracts, or commercial opportunity.
- Loss of goodwill or reputation.
- Costs of project delay, re-work, or resubmission (including planning-application delay, refusal, or abortive cost).
- Loss of, or corruption to, data (beyond our backup obligations described in the Privacy Policy).
- Any claim made against you by a third party (including a client, planning authority, or other professional) arising from your use of, or reliance on, output from the Service.
- Any indirect or consequential loss of any kind.
This reflects the nature of the Service as a drafting aid that you, as the responsible professional, review before use (see §6). It does not affect §10.4, and if you are a consumer it applies only so far as it is fair under the Consumer Rights Act 2015 and does not exclude liability for loss that is a foreseeable result of our breach.
10.3 Cap on liability
Subject to §10.2, our total aggregate liability to you for any cause arising out of or relating to these terms or the Service is limited, to the maximum extent permitted by law, to the greater of:
- The amount you paid us in the 12 months preceding the event giving rise to the claim, OR
- £100.
This cap applies regardless of the form of action (contract, tort, statutory, otherwise) and even if we have been advised of the possibility of such damages.
10.4 What this doesn't exclude
Nothing in these terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot lawfully be excluded under English law.
For consumers (B2C), nothing in this section affects your statutory rights under the Consumer Rights Act 2015.
11. Indemnification
If you are using the Service for business purposes (a B2B user - the typical case), you agree to indemnify us against any third-party claim, demand, proceeding, loss, liability, damages, cost, or expense (including reasonable legal fees) arising from:
- Your breach of these terms (including the acceptable-use rules in §4).
- Your violation of any applicable law.
- The content you submit to the Service infringing or misappropriating any third party's intellectual-property, confidentiality, privacy, or other rights.
- Your use, publication, distribution, or professional submission of output generated through the Service, including any claim that such output infringes a third party's rights or was relied on without the professional review required by §6.
- Your provision of the Service's output to, or use of it on behalf of, any third party.
We will notify you of any claim we expect you to cover, let you control the defence (provided you don't settle in a way that admits fault on our part or imposes obligations on us without our consent), and reasonably cooperate. This obligation survives termination of these terms.
If you are a consumer, this section applies to you only to the extent it is fair and enforceable under the Consumer Rights Act 2015: your liability to us is limited to loss we suffer as a result of your breach that is a foreseeable consequence of it.
12. Termination
12.1 By you
You can close your account any time via Settings → Delete account. See the Privacy Policy for how we handle data on account closure.
12.2 By us
We may terminate or suspend your account if:
- You materially breach these terms (with notice and an opportunity to remedy where the breach is curable).
- You haven't paid for an extended period (after our standard payment-retry schedule).
- We believe your use of the Service is causing harm to other users, third parties, or our systems.
- We're required to by law.
On termination by us for cause: no refund. On termination by us for any other reason (e.g. discontinuing the Service): pro-rated refund of any unused prepaid amount.
12.3 Effect of termination
Provisions that by their nature survive termination (intellectual property, indemnification, limitation of liability, disclaimers, dispute resolution) continue to apply. You lose access to the Service; your data is deleted per the Privacy Policy retention schedule.
13. Disputes - governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
For consumers in the UK: nothing in this section affects your right to bring a claim in the courts of the part of the United Kingdom where you live, where mandatory consumer protection law gives you that right.
We encourage informal resolution first - email us at support@transportplanai.co.uk and we'll do our best to resolve any dispute without escalation.
14. Miscellaneous
- Severability: if any provision of these terms is held unenforceable, the rest continues in effect.
- Waiver: our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: you can't assign these terms without our consent. We may assign to a successor (sale of business, merger, etc.).
- Entire agreement: these terms, the Privacy Policy, and the Cookie Policy form the entire agreement between us about the Service.
- No agency, partnership, or joint venture: nothing in these terms creates any such relationship between us.
- Force majeure: neither party is liable for failure to perform caused by events beyond reasonable control (natural disasters, government actions, infrastructure failures of third parties).
